1. Definitions
1.1. "The Company", "Us", "Our" means Machinery Maintenance Services Ltd and "the customer" means the person, firm or company to whom an order is accepted by the company or a valid quotation stands. "Spares" and "parts" means the goods that are required for the service being provided or the subject of such quotation or order. "Services" means work carried out on your behalf both on or off your premises. "Mileage" means miles travelled to and from your premises and picking up goods on the customers behalf. "Conditions" means these conditions of sale. "Contract" means the contract for the sale of goods and services by the company to the customer governed by these conditions and the "website" means the company's web site on which the conditions appear.
2. Liability
2.1. We will not be liable for any loss of production under any circumstances.
2.2. We will not be liable for any loss/damage/injury to plant or persons for you using any equipment under our service or repair, without the machine being handed back to you as completed and paperwork signed off for acceptance.
2.3. Should any component installed by us and still meeting the warranty conditions fail, then we will only be liable for replacement of the component alone and not the fitting or any subsequent damage caused by that component's failure.
2.4. No warranty will be upheld if overdue outstanding payments on the work are still payable.
3. Service
3.1. Travelling
3.1.1. Mileage and travelling time is specifically measured on the day of the visit and not computer generated due to unforeseen circumstances e.g. traffic or diversions etc.
3.1.2. Mileage and travelling times will sometimes vary from visit to visit due to possible diversions and traffic in rush hours etc.
3.1.3. If there happens to be a delay on the roads we will contact you to confirm whether or not you want us to continue or reschedule your visit.
3.2. Fault diagnosis
3.2.1. Fault diagnosis will take longer if the manuals and drawings are not available, any research or locating drawings is chargeable at current rates.
3.2.2. If the fault is intermittent and equipment begins to work while the engineer is on site without the reason being established, then the visit is fully chargeable.
3.2.3. When the fault is diagnosed but the repairs are not authorised by you to be carried out, then our time is all fully chargeable.
3.3. House keeping
3.3.1. If our engineer decides that the machine area is cluttered/dangerous, then they will wait for the area to be cleared/made safe at current rates or leave your premises and reschedule, this will incur minimum charges.
3.3.2. If our engineer decides a location of the machine is un safe i.e. on poor foundations or things are hanging above in an unsafe manner, then the engineer reserves the right to refuse to service/repair it. The engineer will explain fully their reasons and reserves the right to leave and you will incur minimum charges.
3.4. Tooling and blades
3.4.1. The condition of a shear blade may not be apparent until it is removed, however the blade may be in need of sharpening or replacing. We do not sharpen blades ourselves therefore the turnaround is out of our control.
3.4.2. Should you require your blades refitting without sharpening, they cannot be set perfectly as the cutting edge will be lost and this will be reflected in the cut quality.
3.4.3. If you are requiring tooling setting up, then the tooling will need to be in perfect condition, the engineer will assess the tooling before setting and highlight any issues before the setup procedure.
3.5. Safety systems
3.5.1. Under no circumstances will our engineer remove any safety equipment permanently from your machinery even if the safety equipment is faulty, unless repairing or replacing it.
4. Supply of parts
4.1. Any parts supplied will remain our property until paid for in full.
4.2. Liability for the parts will be your responsibility from the time they are delivered, or once they have been installed if brought by our engineer and any damage caused by you (including trying to use the machine prior to the equipment being handed back over and signed off).
4.3. If in the event an item does fail or adversely wear during the warranty period, then only our engineer shall investigate the issues otherwise the warranty will be void.
4.4. Some parts may be obsolete and need remanufacturing or equivalent replacement parts supplying, which may need additional parts to adapt. Provisions should be made for increase in time and costs to compensate this.
4.5. Delivery times of parts ordered or remanufactured will be outside our control, no liability shall be incurred by us if deliveries are outside the time scales we have been given and subsequently passed on.
4.6. Any parts that need to be ordered or manufactured must be paid for up front if the cost is above the current credit threshold.
4.7. Any parts found to be defective will be replaced subject to clause 2.3.
5. Site access procedures
5.1. Method statement
A generic method statement is available on request. If a more detailed statement is required tailored to your specific needs then the process will be chargeable at the current rates.
5.2. Risk assessment
5.2.1.1. A generic risk assessment is available to cover most environments and production lines. If a detailed risk assessment is required, then this must be carried out on site to properly assess the risks and is chargeable at our current standard rates.
5.2.1.2. If your premises have more hazardous processes or substances than expected in general engineering works, then any warning and guidance must be provided before our work can begin.
5.3. On-site inductions
Any on-site inductions to be undertaken will be chargeable at current standard rates.
6. Charges
6.1. The time charged is from the time our engineer leaves our registered office, until the time our engineer returns to the registered office on your behalf.
6.2. A minimum charge of 3 hours plus actual miles travelled at the current rates plus VAT.
6.3. Some high value special order parts may be subject to full payment before ordering can take place, if above current parts credit limit threshold.
7. Cancellation
7.1. Any cost incurred by us up to the point you cancel our service must be paid for in full.
8. Payment
8.1. Invoices must be paid in no more than 30 days after the date of the invoice.
8.2. Payment of the invoice must be made by BACS / Bank transfer or by cheque.
